Latest regulatory change

South Korea combines VASP registration, anti-money laundering controls and customer-asset protection. Entry requirements were strengthened in August 2026. Tokenized securities legislation has passed, with principal implementation scheduled for February 2027 and implementing rules under consultation; it is not general permission for issuance or stablecoins.

Reason

The FSC and KoFIU establish VASP registration, ISMS and real-name accounts for fiat. Categories differ. A published route is recognised, with banking and product conditions limiting breadth.

Limits

Fiat accounts have additional requirements. Tokenized-securities reforms are not treated as effective prematurely.

Key takeaways

  • Real-name accounts for fiat operations are not identically required of every VASP.
  • Strengthened registration requirements apply from 20 August 2026.
  • The travel rule expansion announced in August has deferred implementation.
  • The DLT securities registration system is being prepared for 4 February 2027.

Frequently asked questions

Conditions depend on the category. Real-name accounts are relevant to exchanging virtual assets and fiat currency; categories without that service exist. Certification and other registration requirements still apply as appropriate. The FSC communication on provider categories explains this distinction.

Principal implementation is scheduled for 4 February 2027. Implementing rules are under consultation from 2 October to 11 November 2026. Some securities provisions applied earlier. The FSC October consultation distinguishes that implementation work from rules already in force.

The user-protection implementing rules provide for the custodian bank to return deposits directly to customers if the provider goes bankrupt or its registration is cancelled, following the prescribed procedure. This concerns fiat deposits; it should not be presented as a general guarantee of the value of every token.

Having that capital is insufficient. The October 2026 consultation proposes that minimum for issuer account management entities, together with staffing and other conditions. It forms part of implementation work for the system scheduled for February 2027. It does not by itself establish that a company can begin that function now or that the proposal has received final approval.

It does not replace the assessment of investment permissions. The FSC explanation of the securities reform retains securities intermediation, offering and disclosure rules. Permission must correspond to the entity and the activity it will perform; the tokenized form of the instrument does not remove those requirements.
