Liechtenstein combines the TVTG civil framework for tokens with MiCA for services within its scope. TVTG registration retains distinct functions but is neither a CASP licence nor ongoing financial supervision. Token transfers must be coordinated with the represented right and its formalities; EEA membership does not turn every national registration into a European passport.
In Liechtenstein, a business may use tokens to represent rights under TVTG while also needing financial authorisation for its services. The first decision is to separate the holder’s right from the issuer’s, custodian’s or platform’s activity.
This distinction has practical consequences: TVTG registration alone does not provide MiCA market access, and digital transfers must have effects on the represented right. Legal design and the provider’s organisation must develop alongside the technology.
How TVTG coexists with financial regulation
The Token and Trusted Technology Service Provider Act, TVTG, regulates representation of rights through tokens and certain professional activities. The consolidated version consulted applies from 1 September 2026. Its civil provisions coexist with financial rules but do not automatically make every token a financial instrument or every activity a MiCA service.
Classification must separate MiCA cryptoassets, financial instruments and other digitally represented rights. Current definitions of certain TVTG providers expressly exclude activities within MiCA. A structure offering several services may need assessment under different regimes; commercial labels such as NFT, utility token or property token do not determine that classification.
What FMA registration means
The FMA explains its role under TVTG: it registers providers and acts on events or notifications, without subjecting them to ongoing financial supervision solely because of registration. Due diligence requirements apply to providers within their scope. Registration must not be advertised as prudential approval of the business or its products.
The same authority handles relevant financial authorisations and MiCA procedures. Provider checks must identify the legal entity, registered or authorised category and covered services. A trading name or directory entry does not establish permission to hold, trade or distribute a particular asset.

Which entitlement each service requires
TVTG Article 12 requires applying for registration before professionally providing registrable services, subject to statutory exceptions. The application depends on the function performed. Technical token creators, tokenization service providers and physical validators do not necessarily assume the same obligations or provide the same service to holders.
For MiCA services, the FMA distinguishes Article 63 authorisation from Article 60 notification for certain already authorised financial institutions. Advance national implementation began in February 2025. Cross-border access depends on the applicable regime and procedure; it does not arise from TVTG registration alone or incorporating a Liechtenstein company.
The FMA's July 2026 announcement confirms that transition ended on 1 July and TVTG registrations for MiCA-authorised activities expired on 2 July. This does not remove all TVTG functions. Before contracting or starting business, current permission must be checked instead of treating the transitional period as an available route.
Connecting a token to the represented right
TVTG Articles 3 to 7 delimit the civil framework, entitlement and disposal of tokens. Article 7 connects transfer to the represented right. Where that consequence does not arise directly by law, the obligated person must make arrangements to secure transfer and prevent parallel disposal of the right.
The structure must therefore specify what holders acquire, against whom they can claim and how underlying asset formalities are met. A token linked to foreign real estate does not bypass local property and registration rules. Article 9a provides for liability of tokenization service providers and physical validators under its conditions, rather than a universal solvency or authenticity guarantee.

Protecting custody and organising resilience
TVTG Article 25 addresses insolvency segregation of tokens and keys held for clients on a fiduciary basis. Pooling is subject to conditions, including availability and identification of client shares. Custody contracts, records and restitution capability must work together. Technical wallet separation does not replace analysis of ownership and insolvency protection.
For operational resilience, the FMA's DORA FAQs distinguish the EU timetable from Liechtenstein implementation, whose legislation entered into force on 1 February 2025. Scope includes financial entities such as authorised CASPs, with exemptions. It must not be extended without analysis to every TVTG provider or company simply using blockchain technology.
What to document before tokenizing in Liechtenstein
The project should describe the represented right, its governing law and the arrangements connecting token transfer to that right. Foreign assets or registration formalities still require compliance with the relevant legal system.
The second check concerns each provider’s current entitlement: a TVTG function, financial authorisation or MiCA notification, as applicable. Custody contracts and records must identify each client’s assets and support their return, including when the provider stops operating.
