Kuwait prohibits commercial virtual asset services, use as a payment or investment instrument and mining under its July 2023 circulars. Regulated securities and financial instruments are excepted, but that exception does not authorise tokenization of any asset. CMA financial technology routes cover specific activities and must be assessed separately from a VASP business.
In Kuwait, a business should begin with virtual asset restrictions before searching for a licence. The 2023 circulars prohibit covered activities and the granting of commercial VASP licences. They also except regulated financial instruments, requiring precise classification of the right.
The exception allows assessment of a particular security’s regime; it does not turn every token into an authorised instrument. This guide explains the boundary with crowdfunding and other financial services, and the documentation needed to assess an offering without confusing technology, commercial and financial permissions.
What the circulars prohibit and which instruments they except
CMA Circular 10/2023, issued on 17 July and published on 18 July, prohibits virtual asset use for payment or investment, the covered services and mining. It also prevents granting commercial VASP licences. This is not merely a risk warning or a temporary application suspension with an established reopening date.
The same text excepts securities regulated by the central bank and other securities and financial instruments regulated by CMA. Legal classification therefore matters: a digital representation of an already regulated instrument requires different assessment from a cryptocurrency. Calling an asset a security token does not trigger the exception or establish that every tokenized model is permitted.
How CMA, CBK and Commerce intervene
The Capital Markets Authority, CMA, regulates securities activities. The Central Bank of Kuwait, CBK, addressed a parallel circular to local banks, finance companies and exchange companies on 17 July 2023. The restriction does not depend solely on CMA jurisdiction and cannot be avoided by choosing another financial intermediary category.
The Ministry of Commerce and Industry published Ministerial Circular 1/2023 with the same prohibitions and regulated-instrument exception. Incorporation or an ordinary commercial licence does not authorise prohibited services. Each project must identify its financial, commercial and technological activities and its connection with Kuwait.
How fintech services differ from VASP licensing
The circulars prohibit granting natural or legal persons in Kuwait commercial virtual asset service licences, whether for their own account or others. No VASP route based on capital, applications or AML registration is presented. A foreign licence likewise does not establish permission to offer those services locally without applying domestic restrictions.
CMA Module 19 regulates securities-based crowdfunding and digital financial advice. Its initial phase began in January 2024, with evaluation from July 2025. Historical application dates should not be advertised as a current window. Current procedures and permissions require service-specific verification; this module is not a cryptocurrency exchange licence.
What a tokenized structure must substantiate
A securities project needs documentation identifying the issuer, economic right, holder register, transfers and intermediary obligations. The circulars' exception preserves analysis under financial regulation; it does not independently establish equivalence between a token and ownership. Treatment depends on the instrument and the infrastructure's function.
The sources examined do not establish a general regime allowing land ownership transfers through token transactions. A contractual token or vehicle interest should not be described as a property deed. Classification and permissions must be resolved before designing trading or custody, including the right's effectiveness against third parties.

Which controls and restrictions remain relevant
The circulars refer to measures under article 15 of Law 106/2013 on anti-money laundering and counter-terrorist financing, without excluding consequences under other supervisory powers. They also require informing customers about risks of virtual asset transactions conducted abroad. That disclosure duty does not authorise intermediation or replace an obliged entity's controls.
The 2024 FATF/MENAFATF evaluation identified shortcomings in effectiveness and risk assessment. Kuwait appears on the June 2026 increased-monitoring list, following its February commitment. FATF explains that listing does not itself require blanket enhanced due diligence or indiscriminate termination of relationships; risk assessment, domestic restrictions and applicable sanctions must be distinguished.
What to check before proposing a project in Kuwait
Prepare the instrument’s legal classification and why an exception is considered applicable. Include holder rights, issuer, recording arrangements and distribution or custody services. Resolve that basis before designing a campaign, admitting customers or contracting an overseas channel.
For crowdfunding or digital advice, check current Module 19 conditions and the specific permission. Do not reuse historical application windows as current dates. Rights formalities and financial controls also require verification; incorporation or an AML programme does not authorise prohibited activity.

Frequently asked questions
No. The instrument must fall within the regulated regime and its offering and services must hold required permissions. The label is insufficient.
No. Its standards contemplate regulation or restrictions according to risk. Kuwait’s prohibition follows from its own circulars.
Ministerial Circular 1/2023 expressly includes virtual asset or currency mining. Examine the project’s actual function before describing it simply as infrastructure. An ordinary commercial licence does not displace that specific restriction.
The Commerce circular requires risk information concerning customers’ overseas transactions, but that duty does not authorise prohibited services. Separate customer information from the business’s actual role. Executing or facilitating transactions requires analysis of the applicable restrictions.
Ministerial Circular 1/2023 prohibits commercial licensing for the VASP business within scope. Incorporation and company registration establish different matters. Before offering a service, identify a legal basis for the instrument and activity rather than infer one from corporate documents.
