Virtual asset regulation and tokenization in Panama

Panama maintains an activity-based approach, with no general VASP license established in the reviewed sources. The SMV placed a particular non-custodial platform model outside its remit, but that does not authorize every financial service. Securities, intermediation, banking and AML require examination under their own regimes. This guide distinguishes administrative opinions, sector permissions and limits of tokenized representation.

Pending evidence prevents a score and position being published. It does not mean an unfavourable assessment.

Reason

SMV opinions place particular models outside its remit without creating a general VASP license. Securities and intermediation rules exist; the IMF FSAP identifies preventive-framework gaps. Comparable access, custody and service evidence remains insufficient for an overall score.

Limits

Current scope and ordinary access remain unverified. Framework absence is not interpreted as prohibition.

Key takeaways

  • Opinion 04-2025 must be read with the facts of the non-custodial model submitted.
  • Exclusion from the SMV remit does not settle permissions in other sectors.
  • Securities offerings and intermediation have different territorial tests.
  • Banking AML duties do not create a general UAF VASP register.
