Denmark applies MiCA with Finanstilsynet as national supervisor. Continuity for existing operators required an application by December 2024 and was limited to eighteen months. The framework distinguishes CASP services, issuance and tokenized securities. FT Lab testing and supervisory technology strategy provide guidance but do not replace permissions or independently establish the validity of tokenized rights.
In Denmark, a business combining tokens, investment management and technology must identify the service it supplies. MiCA regulates in-scope crypto-asset activities; collective fund management and additional third-party services supplied by its manager require separate assessment.
The Danish Financial Supervisory Authority, Finanstilsynet, publishes procedures and criteria addressing these boundaries, including decentralisation. This guide connects them to authorisation, token design and technology testing so that a DeFi label does not replace identification of those controlling the service.
Which activities MiCA distinguishes in Denmark
MiCA applies in Denmark to covered cryptoasset services and issuance, excluding financial instruments. Classification precedes application: tokenized fund units, e-money tokens and assets without those characteristics do not necessarily follow the same rules. Authorisation for one activity does not cover every platform function.
Finanstilsynet's published practice explains that transition required providing services before 30 December 2024 and applying no later than that date. Its maximum duration was eighteen months, potentially ending earlier on refusal. Historical VASP registration or a pending application does not itself extend continuity beyond June 2026.
What Finanstilsynet examines and how managers are affected
Finanstilsynet processes national MiCA authorisations and notifications. Procedures distinguish service providers, asset-referenced token issuers, ARTs, and e-money token issuers, EMTs. Applications must describe each function and entity. Services from another Member State also require assessment of home supervision and cross-border entitlement.
The Danish alternative fund manager guidance draws a useful distinction: collective management alone is not a CASP service. Certain additional third-party cryptoasset activities can, however, trigger MiCA and notification requirements. An authorised fund or manager does not settle the entire perimeter of additional services.

How applications and notifications work
Applications and notifications use the form linked by Finanstilsynet on virk.dk. Article 60 entities must provide complete notification within the required period before starting services. Acknowledgement of receipt is not confirmation of entitlement, and authorisation of one group company does not authorise another.
A supervisory decision published in September 2025 demonstrates that refusal could terminate transitional continuity early. It evidences the conditional nature of that regime rather than determining any current application. Launch planning requires checks of authorisation, included services and operational controls, without promising that filing allows client acquisition to begin.
What Danish DLT securities tests demonstrate
The Deon Digital test reported by the supervisor in 2023 examined DLT securities trading and settlement and potential eligibility for the European pilot regime. Its findings described possibilities and outstanding issues, including cash-leg settlement. They are not general approval of issuances or evidence that every platform qualifies for the same exemptions.
Structures must identify the instrument, enforceable right, obligor and transfer formalities. The technology plan published in September 2026 includes tokenization and financial infrastructure among supervisory priorities. It is a work and dialogue agenda, not itself a constitutive register for all tokens or a change to investor rights.

What controlling an interface or protocol implies
The Danish decentralisation principles distinguish technical architecture from management and control. An interface giving access to a protocol may still provide regulated services despite using smart contracts. Actual controlled functions, contractual relationships and identifiable persons require assessment; a DeFi label does not automatically exclude MiCA.
FT Lab allows bounded testing while maintaining applicable legislation. Participation does not remove required permissions. For commercial operations, DORA and the TFR add technology resilience and transfer information obligations within their respective scopes. Custody and external integrations must be designed together with controls, continuity and incident handling.
How to prepare the model and its testing
Preparation should describe the entity, interface and smart-contract functions, including who can update the system or decide about assets. Where a fund manager participates, separate collective management from additional services. This supports selection of the appropriate authorisation or notification form.
An FT Lab test needs defined objectives and scope. The Deon Digital test is a technical precedent, while the 2030 agenda expresses supervisory priorities; neither establishes the project’s permission. Issuance, settlement and custody contracts must support the legal effects attributed to the token.

Key takeaways
- Former VASP registration no longer replaces MiCA entitlement.
- An incomplete Article 60 notification does not permit services to begin.
- Using smart contracts does not establish fully decentralised service provision.
- FT Lab retains applicable legislation and sets boundaries for each test.

Decentralisation principles
Finanstilsynet publishes criteria for assessing activities presented as decentralised.
Transitional application deadline
Existing operators had to apply no later than this date to qualify for Danish continuity.

The supervisor includes tokenization and infrastructure in its work plan. This is not general authorisation.
Frequently asked questions
Not necessarily. Finanstilsynet distinguishes technical decentralisation from management and control of the activity. The interface’s specific function and user relationships need individual assessment.
