Custody identifies who controls asset-access mechanisms on a client’s behalf. A provider may use cold storage, HSMs, multisignature authorization or multiparty computation; the tool alone does not determine legal treatment.
Key control, position records, segregation and restitution duties differ. Token custody also differs from custody of the represented asset.
MiCA regulates specified crypto-asset custody services within its scope. Tokenized financial instruments follow their relevant financial framework. Provider entitlement and client rights require examining activity and product.
