Sweden applies MiCA under Finansinspektionen supervision. General transition ended in June 2026; court-related arrangements for individual operators require separate verification. Financial entity notification and CASP authorisation are distinct routes. Securities tokenization requires assessment of rights and registers, without treating legislative studies or the supervisor’s innovation centre as operating permissions.
A business tokenizing an asset in Sweden must first determine whether the holder receives a financial instrument or a MiCA crypto-asset. That affects issuance, custody and trading, while Finansinspektionen oversees permission for services within its remit.
The end of transition requires checking current permissions. Meanwhile, Swedish distributed ledger reports provide proposals and economic explanations that must be distinguished from enacted legislation: record technology does not remove instrument rights and formalities.
Separating MiCA from financial instruments
Act 2024:1159 supplements MiCA and designates Finansinspektionen, FI, as competent authority. The European regime distinguishes cryptoasset services, asset-referenced token issuance, ARTs, and e-money token issuance, EMTs. Financial instruments are outside MiCA, so token representation does not replace investment permissions with CASP authorisation.
Swedish transition required applications before 1 October 2025 for continuity while an application was assessed. This must be read alongside the European limit and FI's 1 July 2026 communication, which confirms the end of general transition. A historical application does not establish indefinite entitlement.
What FI supervises and the Riksbank explains
FI supervises national MiCA procedures and obligations allocated by Swedish law, alongside European responsibilities for certain entities. Chapter 2 of Act 2024:1159 also covers supervision of the transfer information regulation. Authorisation, commercial conduct and supervisory communications belong within the same compliance project, even where procedures differ.
The Riksbank analyses money, payments and financial infrastructure; its tokenization reports do not replace FI decisions on providers. Contracting requires checks of the legal entity and entitlement, including cross-border services from another Member State. Familiar branding or membership of a financial group does not establish permission for every advertised service.

Provider entitlement after transition
FI's cryptoasset services guidance refers to European authorisation forms and technical standards. It distinguishes this process from Article 60 financial entity notification, where equivalence depends on entity and service type. Assessment of a complete application does not necessarily include all preparation, remediation and operational changes.
When announcing transition closure, FI identified operators appealing refusals that could maintain certain activity pending court decisions. This is dated information about individual cases, not an exception available to every applicant. Their circumstances are not asserted to remain unchanged: decisions and limits require verification before relying on them to operate or contract.
Connecting tokenization to instrument rights
The Riksbank's March 2026 payments report distinguishes technical token representation from the underlying right: a deposit remains a claim against a bank and a security represents the instrument's rights. This explanation does not validate every contractual design. Ownership, transfer, relevant registration and exercise of rights must be defined.
Report SOU 2023:102 studies financial instruments in distributed ledgers and proposes changes to Swedish book-entry and settlement rules. The official consultation records its legislative development. The report must not be presented as enacted law or its proposed application date as accomplished fact. Issuance requires checks of provisions actually enacted and applicable infrastructure permission.

Controls for transfers, technology and marketing
The TFR imposes information and control requirements on covered transfers. DORA adds resilience, incident and third-party risk management for covered entities. Architecture must support these obligations and custody incident handling; automation does not eliminate responsibility for records, clients or technology providers.
FI's innovation centre uses dialogue and Innovationskompassen to identify uncertainties and develop guidance. It must not be described as a temporary licence or exemption for public testing. Swedish law connects certain MiCA disclosure requirements with marketing law; explanations of risks and rights must match the actual product.
What to verify before tokenized asset operations in Sweden
The project must identify each entity’s permission and check individual conditions, including any court measure. FI’s communication on particular appeals must not become a general continuity rule for unauthorised firms.
For tokenized securities, establish the rights, records and settlement rules applicable to the transaction. SOU proposals and dialogue with the innovation centre can help frame questions, but the structure must rely on enacted rules and specific permissions before serving clients.

Key takeaways
- Former AML registration does not establish current MiCA authorisation.
- Court decisions concerning individual operators do not create a general extension.
- Provider authorisation does not guarantee asset value or liquidity.
- SOU 2023:102 is a reform report, not a DLT registration law that can be presumed effective.
