Louisiana requires a licence for virtual currency activities covered by the VCBA, with entity-specific and functional exemptions. In 2026 it removed the framework’s scheduled sunset and strengthened kiosk refund rights. Self-custody and specified blockchain uses have statutory protection, while financial services retain their own requirements. The new money transmission law includes transition and the unclaimed digital asset regime starts in 2027.
A business serving Louisiana residents needs to separate virtual-currency permission from fiat payments, securities and bank-custody requirements. The state has a specific licence, but the operator’s actual function and exemptions still determine the appropriate route.
Platform design involves both obtaining permission and organising subsequent duties. This guide connects licensing, customer rights, asset safeguards and kiosk rules, distinguishing applicable provisions from changes scheduled for 2027.
Which permission applies to each Louisiana service
The Virtual Currency Businesses Act, VCBA, enacted in 2020 and amended in 2023, regulates virtual currency services involving Louisiana residents. A provider’s location outside the state does not itself remove coverage. Its definitions include exchange, transfer, storage and administration, alongside specified electronic precious metal certificates. The assessment depends on the activity and effective control over assets.
Section 6:1383 provides entity-specific and transactional exemptions, including activities governed by securities legislation to the statutory extent. Mining and NFT minting fall outside the specific VCBA business activity definition; additional custody or exchange services require separate assessment. A technology label alone does not determine an exemption.
The 2024 Blockchain Basics Act protects private acceptance of digital asset payments and self-custody against governmental restrictions. It permits home mining subject to noise ordinances and business mining in industrial zones under applicable ordinances. Its CBDC restrictions concern acceptance, compulsory payment and testing by public authorities; they do not prohibit every private digital currency.
Which authority supervises each activity
The Office of Financial Institutions, OFI, administers VCBA licensing through its Non-Depository division. Its Securities area administers offerings and intermediaries subject to state securities law. Submitting an application through NMLS, a shared filing system, does not itself confer a licence or nationwide passport.
Federal requirements remain applicable according to activity. The United States guide covers that common layer; this guide addresses state differences. For banks and trust companies, Section 6:1402 permits virtual currency custody within their powers, subject to risk assessment, controls, insurance coverage and provider oversight. That institutional route is not automatically available to every technology company.

Which permission the business model requires
OFI began accepting applications in January 2023 and has required licensing since July that year. The VCBA application covers the business model, responsible persons, backgrounds and financial information. Administrative rules set application fees of $5,000 and renewal fees of $4,000, with additional charges where applicable. The former simplified registration route was removed in 2023; historical references do not establish a current alternative.
Section 6:1386 requires a surety bond and tangible net worth. The bond starts at $100,000 and increases according to volume or supervisory decision within the statutory ceiling. Net worth has a floor and graduated asset-based calculation; it is not a fixed contribution sufficient for every business. Evidence of compliance requires audited financial statements and continuous maintenance.
Act 923 of 2026 removed sunset clauses that scheduled termination of specified provisions for July 2027. The OFI notice confirms the change. The Act retains a federal pre-emption provision only to the extent of conflict; it does not extinguish the entire VCBA whenever federal legislation is enacted.
Monetary flows require separate assessment. The Louisiana Money Transmission Act, Act 888, has applied since 1 July 2026, replacing the previous statute. For existing licensees, new or conflicting requirements have a transition until renewal or twelve months after effectiveness, whichever is later. Multistate harmonisation does not eliminate the applicable state licence.
How holder rights are documented
An issuance must define the holder’s entitlement, the obligor and acquisition and transfer formalities. Representing property or a receivable through a token does not itself prove direct ownership of the asset. Issuer documents and the legal effect of relevant records must support the relationship offered to investors.
The Blockchain Basics Act expressly preserves state and federal securities law. OFI distinguishes registered offerings, exemptions and notice filings. A placement relying on a federal exemption may retain state filing requirements; VCBA authorisation likewise does not replace requirements for securities distribution, advice or trading.
Electronic certificates connected to precious metals are expressly covered by VCBA definitions. A tokenization project must therefore assess both the represented right and issuance, holding and transfer functions. Describing a token as “backed” does not resolve its classification or establish verifiable reserves.

Which obligations continue during operations
Section 6:1386.2 requires a licensed custodian to hold the same type and amount of virtual currency owed to residents, restricts its use and prohibits commingling. The operational exception allowing proprietary funds in a customer account treats them as resident assets and limits withdrawals to the excess. These balances do not thereby become insured bank deposits.
Compliance policies must address fraud and money laundering prevention, cybersecurity, privacy and information security, with governing-body approval and designated responsible individuals. Protection for nodes, mining and staking preserves anti-fraud powers and securities law; it does not provide immunity for investment services.
Kiosks have a $3,000 daily limit per user. Act 482, effective from August 2026, allows operators to wait 72 hours before processing or permit cancellation and full refund during the following 72 hours. Where the operator was unlicensed at the transaction date, the user may cancel and seek a full refund at any time. The statute distinguishes an initial response within ten business days from refund payment within ninety calendar days, with special calculation where a report and identification are required for suspected fraud.
Act 891 takes effect on 1 January 2027. It addresses digital accounts presumed abandoned after three years under its conditions, indications of owner interest, notices and delivery to the administrator. It provides for delivery in native form and liquidation in specified circumstances. It does not require automatic sale of every balance without transactions for three years.
What to prepare before launching the project
Identify resident customers, assets, key controls and functions performed directly or through suppliers. Separate fee budgets from own funds, bonds and backing of liabilities. For fiat flows, explain why the relevant transmission framework does or does not apply.
For kiosks, customer service procedures should address cancellations, identification, fraud reports and deadline calculations. Update documentation based on the former simplified registration or 2027 sunset before relying on it for launch.

Key takeaways
- Virtual currency licensing has been required since July 2023; the 2026 reform removes the sunset scheduled for 2027.
- Self-custody, private payments and mining have defined protections; these do not exempt securities or authorise every intermediary function.
- Kiosks have a $3,000 daily limit and cancellation rights; responding to requests and paying refunds have different deadlines.
- The specific unclaimed digital asset regime is enacted for January 2027 and does not require automatic liquidation of every inactive account.

Frequently asked questions
OFI states that the 2023 amendment repealed that registration exception. Compare any historical file with the current licensing route.
OFI’s Act 923 notice confirms removal of that sunset. It retains a federal-conflict rule for affected provisions rather than an assumed blanket termination.
Act 482 allows cancellation and a full refund at any time when the operator was unlicensed for the transaction. Lack of permission is not merely a paperwork defect.
OFI describes LMTA transition for existing licensees. A new business must check its own access rather than assume continuity granted to an earlier licensee.
The minting exclusion concerns that function. Custody or exchange of customer assets needs separate assessment based on the actual service.
