Slovenia applies MiCA through ATVP and Banka Slovenije according to product and entity. Domestic transition ended in July 2025, before the EU maximum. Its 2024 sovereign digital bond demonstrates a specific tokenization transaction but does not authorise every private issuance or replace service and infrastructure permissions.
In Slovenia, a business can find both a European crypto-asset service framework and a concrete sovereign digital bond precedent. They serve different purposes: the government bond documents a transaction, while MiCA and ZIUTK determine requirements for activities within their scope.
The Securities Market Agency, ATVP, and Banka Slovenije divide responsibilities according to asset and entity. This guide explains that allocation and separates service authorisation, issuance documents and the enforceability of rights represented by tokens.
What MiCA and ZIUTK establish
MiCA governs crypto-assets and services within its scope. Slovenia implements it through ZIUTK, effective from November 2024. Classification remains decisive: securities, deposits and electronic money receive different treatment. Blockchain use neither replaces assessment of product rights nor makes every technology activity a regulated financial service.
ESMA's transition table identifies a six-month Slovenian period. ZIUTK Section 21 set 1 July 2025 as the limit, or an earlier authorisation or refusal decision. The EU maximum in July 2026 did not automatically extend that domestic deadline or give former registered operators passporting rights.
What ATVP and Banka Slovenije each do
ZIUTK Sections 3 and 4 assign CASP authorisation and responsibilities concerning ARTs and other crypto-assets to Agencija za trg vrednostnih papirjev, ATVP. Coordination with Banka Slovenije applies to certain banking cases. The allocation is not simply banking supervision for every stablecoin and securities supervision for every other token.
Banka Slovenije receives EMT white-paper notifications and notifications from electronic money institutions providing custody or transfers of their own EMTs under Article 60. EMT issuance requires the corresponding banking or electronic money institution status. CASP authorisation does not replace that status or the separate issuance requirements.

Which procedure permits service provision
Applications must specify services, governance, qualifying holdings, resources, controls and the programme of operations under MiCA. Institutions relying on Article 60 must establish eligibility and complete the relevant notification. Cross-border services additionally require verification of Article 65 procedures, the entitled entity and the activities covered.
ZIUTK Section 13 provides judicial protection against decisions and where no decision is taken on a complete application within six months. It does not create authorisation by silence or permit operations merely because time has elapsed. Preparation, remediation and supervisory assessment preclude treating statutory periods as commercial guarantees.
What the Slovenian digital bond demonstrates
The Ministry of Finance records a EUR 30 million sovereign digital bond issued on 25 July 2024. Settlement occurred within Eurosystem wholesale central bank money experimentation, using Banque de France's solution and the Neobonds platform. This demonstrates an identifiable transaction, not a general rule permitting private issuances.
Tokenized financial instruments retain applicable issuance, registration and service requirements. The DLT pilot establishes a specific regime for eligible infrastructure. Documentation must address debt or participation rights, entitlement, transfer and insolvency treatment. Control of private keys must not be equated automatically with legal ownership of the represented asset.

Which controls regulated operations require
DORA requires technology resilience for entities within its scope, while the Transfer of Funds Regulation adds originator and beneficiary information for affected operations. Custody should coordinate segregation, reconciliation, access and recovery. Anti-money laundering controls and international restrictions continue to require assessment of customers and transactions.
Banka Slovenije's fintech contact point clarifies requirements within its remit. The institution expressly states that it is neither a testing environment nor a source of specific advice on innovative services. Presenting a project or receiving clarification does not constitute authorisation, exemption or institutional validation of contractual arrangements.
How to prepare issuance, services and settlement
Preparation should first determine whether the asset is a financial instrument, EMT, ART or another crypto-asset and assign each service to its provider. That map directs engagement to ATVP or Banka Slovenije and distinguishes provider applications, notifications and issuance information.
The sovereign bond precedent helps frame registration and settlement questions, but the project’s own contracts and permissions must answer them. Define rights, transfer and insolvency treatment before selecting infrastructure. Procedural questions go to the competent supervisor; the fintech contact point is neither authorisation nor a testing environment.
