Digital asset regulation and tokenization in Ireland

Ireland applies MiCA with the Central Bank of Ireland as national authority. The VASP registration transition ended in December 2025, without automatic conversion to CASP authorization. The Consumer Protection Code 2025, applicable from March 2026, and payment rules may add obligations. Tokenization requires assessment of rights and transfer: the central bank’s DLT discussion paper is not a general authorization.

Reason

The Central Bank applies MiCA and publishes CASP procedures and an entity register. Operational authorization and passporting exist. The European DLT Pilot provides a specific financial-instrument route with separate permissions.

Limits

Former VASP registration does not replace MiCA. Authorized domestic DLT infrastructure is not established.

Is crypto legal in Ireland?

Yes. Businesses have regulated routes to operate with crypto-assets, under predictable rules. The Central Bank applies MiCA and publishes CASP procedures and an entity register.

In the Metlabs Regulatory Index it scores 95/100 and ranks 6 of 76 countries assessed (assessed October 3, 2026). See the country ranking

Key takeaways

  • Ireland shortened the European transition to twelve months, and former VASP registration does not confer simplified or automatic CASP authorization.
  • CASP applicants use the CBI Portal from April 2026.
  • The consumer protection code can also apply to providers operating through passporting.
  • The Innovation Sandbox does not grant regulatory waivers for consumer product testing.
  • Failure to decide on a complete application within six months is appealable.

Regulatory milestones

  1. National MiCA framework takes effect

S.I. 607/2024 designates the CBI as competent authority. Commencement precedes publication of the notice in Iris Oifigiúil on November 12.

  2. MiCA service rules apply

The European CASP regime applies alongside limited Irish transition.

  3. Kraken announces Irish MiCA authorization

The company announces that it has obtained CBI authorization. This records the announcement date without claiming the first national permission or equating it with subsequent commercial activation in other markets.

  4. Statutory VASP transition deadline

Regulation 20 of S.I. 607/2024 shortens the European maximum of eighteen months to twelve and sets December 30, 2025, or an earlier authorization or refusal decision. References to the end of December in explanatory materials do not extend that statutory deadline.

  5. DLT and tokenization discussion

The CBI publishes Discussion Paper 12, which covers, among other topics, tokenization of funds and reviews trials of primary bond issuance on DLT. It is a consultation, closed to responses on June 5, 2026, not a general authorization of tokenized models.

  6. Consumer Protection Code 2025

The Consumer Protection Code 2025 starts applying, covering MiCA activities under its conditions.

  7. CASP application portal

The CBI requires CASP application documentation to be submitted through its portal.

Frequently asked questions

No. The CBI distinguishes AML registration from financial authorization. MiCA requirements must be met through authorization or the applicable route for the entity and its services.

The program does not grant regulatory waivers for consumer testing. Firms must check their permissions and obligations and cannot present participation as CBI endorsement of their product.

For crypto-assets other than ARTs and EMTs falling under MiCA Title II, Article 8 provides for notification without prior approval by the authority. This must not be presented as product endorsement. Offer conditions, potential exemptions and the offeror’s disclosure requirements also need to be checked.

The CBI expects local substance and autonomy, with management and a board able to understand, make decisions about and control the business. Outsourcing or group membership does not remove that responsibility. The specific organization is assessed against the model and its risks.

Revenue explains that designated persons must report to both Revenue and the Irish Financial Intelligence Unit through their respective channels. These are separate submissions. Anti-money laundering reporting also does not replace any market abuse reports due to the CBI.
