Florida distinguishes virtual currency transmission, stablecoin issuance and securities offerings. Effective control over third-party transactions helps determine licensing scope. The main stablecoin issuer provisions apply from October 2026, with regulatory implementation and federal coordination requiring confirmation. The kiosk legislation enacted in June has a separate timetable for 2027. Tokenization requires documentation of the represented right and its transfer.
A business planning a wallet, digital asset exchange or stablecoin in Florida first needs to describe who controls and executes transactions. The state distinguishes transmitting third-party value from issuance, and both require coordination with federal rules.
For tokenized issuance, the right received by the customer also matters: a security, ownership interest or claim is not classified by its technology. This guide explains access routes, the financial authority’s role and the specific timetables affecting issuers and kiosks.
Which activity Florida regulates in each model
Florida regulates virtual currency transmission under Chapter 560 where the activity falls within the statutory definition of intermediation. Section 560.103 requires the ability to execute a transaction unilaterally or prevent it indefinitely. Receiving and transmitting assets for others requires a functional assessment; developing software or buying assets on one’s own account does not, by itself, establish that activity.
The Office of Financial Regulation’s August 2022 alert explains the change applicable from January 2023. The 2019 Espinoza judgment had extended licensing to direct sales; subsequent legislation narrowed the intermediary definition. Using that judgment as the current rule, or attributing a general exemption to the case, misstates the legal development.
Chapter 2026-176, signed on 26 June, establishes specific routes for payment stablecoin issuers, with its main provisions applicable from 1 October 2026. Section 671.201 excludes central bank digital currency from the commercial-law definition of money. That exclusion is neither permission for private cryptoasset services nor a federal prohibition imposed by Florida.
What belongs to OFR and the federal framework
The Office of Financial Regulation, OFR, processes and supervises monetary licences. Its respective divisions exercise securities and financial-institution functions, while the Financial Services Commission develops rules. State responsibilities interact with the federal framework described in the United States guide. Establishing a Miami office does not remove permissions required where customers reside.
The Department of Financial Services administers the section 17.72 pilot for specified departmental fees and payments. Statutory authority depends on eligible stablecoins and issuers; without federally or state-approved qualified issuers, it cannot conduct the authorised activities. The legislation does not establish that every tax or incorporation fee can already be paid in bitcoin, or that a particular commercial integration exists.

Which permission transmission or issuance requires
Section 560.204 requires a licence for covered transmission for compensation, unless an exemption applies. Compensation includes the economic result of a virtual currency exchange. The OFR publishes an electronic application process and application, net-worth, security and periodic reporting requirements. Assessment must identify who receives assets, controls transfers and contracts with customers; describing the business as a technology platform does not resolve those questions.
Chapter 560 Part V governs state-qualified payment stablecoin issuers. Trust companies have a separate section 658.997 approval certificate. Federally qualified issuers and certain qualified issuers from other states benefit from specific exceptions; the latter must notify the OFR within thirty days of conducting the covered Florida activity. Personal-transfer and self-custody exclusions have the particular scope of these provisions.
Issuance permission covers issuance, redemption, reserves and directly related activities; it does not authorise every investment service. The 24 September 2026 regulatory notice starts rule development for forms, capital, liquidity and risk management. This is preparatory action, not a final rule or individual permission. Before issuance, confirm the applicable process and state-certification coordination under GENIUS, the federal stablecoin framework.
How to connect a token with its holder’s right
Section 669.104 governs acquisition of rights in controllable electronic records. A qualifying purchaser may acquire the record free of specified claims under the statutory conditions. The provision distinguishes those rights from a represented claim, performance obligation or asset. A real-estate token must document whether it represents an equity interest, debt or another entitlement; holding a key does not automatically replace real-property transfer requirements.
Section 669.105 defines control through powers over benefits, exclusion of others, transfer and identification of the person exercising them, with rules for shared powers and control through another person. Custody architecture must satisfy those requirements. Securities offerings remain subject to section 517.07 and its exceptions; section 517.12 addresses intermediaries and advisers. Only stablecoins satisfying the relevant regime fall outside Chapter 517 through that route.

Which controls and timetables affect operations
Section 560.210 requires a transmitter receiving virtual currency for onward transmission to maintain the same type and amount until its obligation is completed. For stablecoin issuers, the 2026 legislation requires eligible reserves of at least one to one, a redemption policy, monthly publication and examination of reserves by a registered accounting firm, plus executive certifications. Reserve backing does not insure the customer’s balance as a bank deposit.
Kiosk legislation, Chapter 2026-178, generally applies from 1 January 2027, with its specific registration requirement from 1 March. It provides daily limits of USD2,000 for customers of fewer than seven days and USD10,000 for others, together with disclosures and receipts. A first transaction qualifies for a full refund within seventy-two hours under specified conditions: notifying the operator and an authority of fraud within sixty days, and evidence such as a police report or sworn affidavit. This law does not already impose those duties in October 2026.
What to check before putting the service into operation
The project should assemble customer contracts, a transaction-control diagram and the flow of money and assets. For stablecoin issuance, separate reserves, redemption and distribution from exchange or custody functions. For tokenized securities, prepare the instrument’s classification and offering conditions.
A law taking effect does not establish a decision on a particular application. Before launch, confirm the available OFR route, implementing rules and federal coordination. Kiosk adaptations for 2027 need their own timetable and should not be presented as duties already applicable in October 2026.

Key takeaways
- Since 2023, the transmitter definition requires intermediation with the ability to execute a transaction unilaterally or prevent it indefinitely.
- The 2026 stablecoin law distinguishes issuers, trust companies and qualified external operators; enactment does not establish federal certification.
- Kiosk legislation combines general application in January 2027 with the specific registration requirement from March.
- Control of an electronic record does not automatically make the token holder the owner of its underlying asset.

Frequently asked questions
Permission belongs to the authorised entity and activity. The technology contract should identify the supplier’s actual powers, especially if it can execute or prevent customer transactions.
Chapter 2026-176 limits issuance permission to its functions and directly related activities. Trading, intermediation and other services require separate assessment.
Reserves back an issuer obligation under its framework; they do not justify advertising the user’s balance as an insured deposit. Marketing should describe the protection actually available.
Check customer locations and the framework applying to each service. Local permission does not itself replace federal or other-state requirements.
No. Check the agency, accepted payment, issuer and actual service availability. Conditional statutory authority does not establish that every integration is operational.
