Jamaica has supervisory requirements for digital assets classified as securities and is developing a separate VASP regime. The House of Representatives passed the bill in September 2026, but enactment, commencement and operational access have not been verified. The proposal covers foreign providers serving Jamaican clients. JAM-DEX is central-bank digital currency and does not itself authorise private exchange, issuance or custody services.
A business planning a digital asset offering in Jamaica should first establish whether it offers a security. That determines whether it fits the FSC’s 2023 advisory, involving issuers, dealers and a recognised exchange, or requires assessment under another perimeter. An investment token and a cryptocurrency exchange business do not automatically share the same route.
Timing is the second issue: Jamaica consulted on VASP requirements and advanced a parliamentary bill during 2026. Budgeting and launch planning must distinguish those proposals from a permission that an entity can obtain and exercise today. JAM-DEX, as central-bank currency, does not settle market access for a private issuer.
What the securities advisory covers and what remains proposed
Jamaica distinguishes digital assets classified as securities from services involving other virtual assets. The November 2023 FSC advisory defines its digital asset as a representation of a security, often an investment contract, whose ownership is verified and recorded using DLT. It replaces the 2019 advisory without modifying or overriding the Securities Act and implementing rules.
Debate on the Virtual Assets Service Providers Bill began on 22 September 2026. Official information service JIS reports passage in the House of Representatives on 29 September. This review has not verified the enacted text, commencement or operational procedure. Parliamentary progress is not presented as current authorisation for all proposed services.
The FSC’s role and the distinction from JAM-DEX
The Financial Services Commission, FSC, supervises securities markets and leads preparation of the VASP framework. Its June 2026 consultation acknowledges that this would introduce a supervised population distinct from securities and insurance. The supervisory register should be checked for legal entity, activity and permission scope; incorporation does not establish those conditions.
The Bank of Jamaica, BOJ, has monetary and payment functions. Its JAM-DEX guide distinguishes central-bank digital currency from privately issued cryptocurrencies. JAM-DEX is distributed through banks or authorised payment providers. This infrastructure does not entitle a private issuer to present its token as sovereign currency or a BOJ-approved product.

What the securities route requires and the VASP regime proposes
For securities, the FSC advisory requires issuer and asset registration, alongside prior approval for dealers intending to offer these services to clients. Trading takes place on a platform operated by a recognised stock exchange. Market makers have separate requirements, including Jamaica Stock Exchange approval and suitability assessment; deploying a technical platform is insufficient.
The VASP consultation, running from 11 June to 10 July 2026, proposes six classes covering platforms, advice, custody, brokerage, wallets and conversion. It also proposes capital, a functioning office, resident officers, locally accessible documentation and a bank account. These remain proposed conditions, not definitive requirements, current fees or promised licensing times.
According to the government's explanation of the bill, future licensing would reach foreign businesses serving people in Jamaica. Cross-border acquisition strategies require checking the final text and transition. An exemption based on offshore server location is not presumed, and securities permissions are not attributed universal coverage for other virtual assets.
Documenting investors’ rights
The securities advisory's reference to ownership recorded using DLT requires identification of the represented instrument. Equity, debt or an investment contract retains its rights and issuance conditions. Regulatory asset registration does not itself establish direct ownership of associated property; contracts, corporate structures, registers and formalities for the particular right require examination.
Myers, Fletcher & Gordon's 2019 analysis already distinguished securities, currency and payment services. It provides historical classification context rather than proof of the 2026 regime's effectiveness. Likewise, historical agreements and trading pilots are not treated as evidence of current access to authorised infrastructure for every tokenized offering.

Controls required for digital asset distribution
For dealers within the 2023 advisory, the FSC requires risk and compliance policies, investor declarations and trading procedures; it addresses client-fund segregation and prohibits proprietary positions in those assets. Admission distinguishes accredited investors and individuals demonstrating knowledge through experience or training, with exclusions. It is not unrestricted retail access without assessment.
Dealers must provide periodic information on clients, volumes and onboarding deficiencies. The VASP proposal adds custody, conflicts, advertising, cybersecurity and AML standards, but consultation does not automatically make them binding. The May 2026 FSC warning addresses platforms fabricating balances, results and connections with established companies: these features do not prove authorisation.
Preparing the project while the framework develops
Start the application file with the offered right, issuer, intermediary and trading venue. Under the securities route, customer eligibility and segregation of funds must be designed before distribution; enabling a wallet connection is insufficient.
For a VASP service, prepare a budget conditional on final requirements and verify enactment, commencement and application instructions. The official information retrieved confirms progress in the House of Representatives, but is not treated as evidence that a new general licence is already available for operations.

Key takeaways
- Passage in the House of Representatives does not establish available VASP licensing.
- The 2023 FSC advisory concerns securities; it is not a general permission for every cryptoasset.
- VASP capital, substance and licence classes consulted on in 2026 remain identified as proposals.
- JAM-DEX and a private stablecoin have different issuers and legal regimes.

Frequently asked questions
No. Its digital-asset definition concerns securities represented using DLT and requires registered entities and recognised exchanges. It does not replace the VASP framework being developed in 2026.
No. JAM-DEX is BOJ digital currency. Private issuance requires examination of its own rights and obligations; a wallet or Jamaican-dollar denomination does not make a token central-bank money.
The 2023 FSC advisory prohibits securities dealers from holding proprietary digital asset positions. They must distinguish that restriction from providing services to customers.
No. The 2023 FSC advisory also requires an eligible category: a qualifying accredited investor or a knowledgeable individual with evidence of trading experience, work experience or training.
Not on its own. The official JIS report confirms September’s parliamentary progress. Enactment, commencement and applicable instructions must be checked before representing a project as authorised.
